MTC Approves Rules on Numbering for Commercial and Advertising Communications
By means of Supreme Decree No. 018-2026-MTC, published in the Official Gazette El Peruano on September 15, 2026, the Ministry of Transport and Communications (MTC) approved the Rules on Numbering for the Identification of Calls and Text Messages Made for Commercial and/or Advertising Purposes.
The new framework implements Law No. 32323, which amended the Consumer Protection Code to broaden the prohibition on SPAM communications. The Law, enacted following congressional insistence, also mandated the Executive Branch, through the MTC, to establish complementary rules governing the use of special telephone numbering by providers of commercial and/or advertising communications, including security measures, validation mechanisms, and other applicable technical requirements.
The regulation establishes the framework applicable to the identification of such communications through dedicated numbering, with the aim of enabling users to identify their commercial or advertising nature and strengthening the safeguards applicable to these communications.
