A U.S. Federal Court of Appeals rejected the attempt by Meta, Google, TikTok, and Snap to invoke Section 230 of the Communications Decency Act as a form of immunity that would prevent thousands of lawsuits concerning alleged social media addiction from proceeding.
The ruling allows these proceedings to move forward, enabling courts to examine claims seeking to hold the platforms accountable for allegedly harmful design features, particularly those affecting children and adolescents. In other words, the courts may now proceed to consider the merits of the underlying claims.
We are pleased to share a summary of this noteworthy decision in litigation that remains ongoing, prepared by our consultant, María José Yuriko Rodríguez Nakagawa.
