Legal Alert – Insight 32

By: Virginia Nakagawa—Regulatory Consultant, and Marlon Gorbeña Peña—Legal Intern

Through Resolution No. 126-2026-CD/OSIPTEL (Official Gazette, October 1, 2026), OSIPTEL Official has approved the Regulation Establishing Provisions for the Implementation of the Regulatory Sandbox.

This new regulatory framework establishes a mechanism enabling telecommunications operators to develop experimental projects involving public telecommunications services within a controlled environment, subject to regulatory flexibility with respect to rules and requirements within the regulator’s regulatory remit.

The Regulatory Sandbox represents a significant step toward fostering regulatory innovation, technological experimentation, and the development of new telecommunications services, while maintaining appropriate safeguards and regulatory oversight.

We are pleased to share a brief analysis prepared by our consultant, Virginia Nakagawa, together with Marlon J. Gorbeña Peña.
