On June 11, 2026, Indecopi officially published the “Guidelines on Cooperation Agreements Between Competitors for Conduct Subject to Relative Prohibition”, which is aimed at providing guidance to businesses in structuring horizontal collaborative arrangements without giving rise to infringements associated with anti-competitive practices.
While the Guidelines are non-binding and intended solely for guidance purposes, they offer valuable direction for companies seeking to achieve efficiencies that should ultimately be passed on to consumers. We encourage their review and dissemination, as they are relevant to all participants in the marketplace.
